科學的特性是「客觀可驗證」，法學不能如此，所以，法學不是科學。科學研究必須交代方法，依照這個方法，研究結論應該一致。法學固然有方法，但依照一樣的方法，研究者無法得出一致的結論。正因為法學研究沒有客觀可驗證的答案，所以必須更加的小心謹慎，不能只是依賴權威，依賴通說，而應該「質疑並持續探求」。這一點，法學又與科學的精神相通。
“Objective testability” is characteristic of science, but it cannot be applied to research of jurisprudence. Therefore, jurisprudence is not science. In the field of science, one has to clearly explain the research methods. Following the same methods, the results will be always consistent. As much as there are result methods in jurisprudence, following the same methods, the results may not necessarily be consistent. Since there is no objective testable answer to research of jurisprudence, we have to be even more cautious. We cannot simply rely on authorities or general theories but rather on “doubtful and continuous quest.” That is the common point between jurisprudence and science.
